     The NEW Industrial Relations System

BACKGROUND

 

The new workplace relations system, including the new collective bargaining and unfair dismissal frameworks, commenced on 1 July 2009. Parts of the Fair Work Act 2009 concerning agreement making, industrial action, compliance, general protections and right of entry are necessarily connected with these frameworks and also commenced at this time.

 

Some of the key features of the new workplace relations system are, a system based on bargaining at the enterprise level, protections from unfair dismissal for employees, protection for the low-paid, a balance between work and family life, and the right to be represented in the workplace. The Fair Work Act 2009 promotes national economic prosperity and social inclusion by providing a balanced framework designed to encourage cooperative and productive workplace relations [Division 2, Section 3].

HOW DO THE CHANGES APPLY TO ME?

The Fair Work Act will have a broad reaching impact on most Australian businesses and will affect more than 85% of the workforce. Businesses that are companies and those that are in Victoria and the Territories will be immediately impacted. At some stage States that have their own workplace relations systems may refer their legislative powers to the Commonwealth (representatives of Tasmania, South Australia and Queensland have said they are actively considering making such a referral).

 

THE RESTAURANT AND CATERING INDUSTRY AWARD

 

One of the key features of the new industrial relations system are Modern Awards. Modern awards and the National Employment Standards comprise the new minimum safety net to replace existing awards and statutory minimum standards, including the Australian Fair Pay and Conditions Standard.

 

The modern award for the restaurant and catering industry is currently being developed by the Australian Industrial Relations Commission. It is scheduled for release on the 4th December 2009 and will be implemented in January 2010.

RESTAURANT & CATERING INDUSTRY LEGENDS HONOURED

The restaurant and catering industry has a large number of achievers within the ranks of its 200,000 strong workforce, and Restaurant & Catering Australia would like recognize these individuals for their contribution to the industry.

 

In 2003, the Lifetime Achiever Program saw was launched. The inaugural Lifetime Achiever’s were decided on based on their outstanding achievements, efforts and dedication to the restaurant and catering industry, in their state and/or nationally.

 

Each year, each State Association calls for nominations for Lifetime Achievers in their State. At State Awards for Excellence events, if nominations have been received, and approved by their individual State Boards, they announce their State Lifetime Achiever.

 

Nominations are also received from each state for a National Young Achiever. Only 1 person is celebrated as the Young Achiever in Australia each year.

 

The Lifetime Achievers and Young Achiever are then recognised, honoured and celebrated, at the Annual Lifetime Achievers Dinner, sponsored by Fine Wine Partners and Henschke, in Canberra

HOSTPLUS WINS SUPERRATINGS 2009 FUND OF THE YEAR FOR THE THIRD CONSECUTIVE YEAR

 

Industry Super Fund, HOSTPLUS was awarded the prestigious SuperRatings 2009 Fund of the Year at an industry awards function held in Melbourne last night.

 

HOSTPLUS has made it “3 in a row” with Fund of the Year honours in 2007, 2008 and now 2009.

 

Chief Executive Officer David Elia said the award was recognition for its consistent performance across its investment categories.

 

“All financial services providers are operating in a period of unprecedented market volatility. This highly acclaimed award confirms that our investment management practices and our business and operational strategies are delivering real value and benefits to our membership.

 

Mr Elia said being honoured with the top accolade for three years in a row is an outstanding achievement which bears great testimony to the dedication and skill of our team.

Restaurateurs Certification & Accreditation Scheme

Recent research by Restaurant & Catering Australia has determined the skills necessary for operating a successful restaurant business. It is likely that you possess a number of these skills but may not have formal recognition for them.

Restaurant & Catering Australia now provides restaurateurs with the opportunity to demonstrate that they are part of the ranks of professionals by helping them receive certification for their skills and subsequently allowing them to apply for accreditation for their individual businesses. The certification process will assist in setting an industry standard for Certified Professional Restaurateurs.

The Restaurant Certification and Accreditation Scheme is a two-staged process including the Certified Professional Restaurateurs (CPR) program and the Restaurant Accreditation program.  The ultimate aim of the scheme is to improve the quality and professionalism of restaurant businesses and industry personnel, and ultimately, the quality of the dining experience to restaurant customers. The specific aims of the program are to:

  • Promote the development of quality business management practices and foster high levels of professionalism within the industry
  • Facilitate training and personal development for industry management practitioners
  • Provide formal recognition and reward to industry individuals and organizations which commit to and achieve quality through certification and accreditation
  • Assure a quality dining experience to all restaurant guests
  • Facilitate industry compliance with legislation and regulation

 In short, the CPR program will recognize the skills restaurateurs have in the management of their businesses.  When certified, it is hoped that restaurateurs will then subsequently apply to have their businesses accredited through the AR program.

The Restaurateurs Certification and Accreditation Scheme is your way of showing you ARE a professional, and your business provides quality products and services.

2008 Savour Australia National Awards for Excellence

The 2008 Savour Australia National Awards for Excellence were held on Monday 27th October at the Brisbane Convention & Exhibition Centre in QLD. The event that was carbon neutral was attended by 700 people who were treated to an amazing experience of sensational food from the BCEC and a selection of fine wines from Fosters, beer from Fosters and Lion Nathan and softdrink and mineral water from Coca Cola.  

The National Awards are the final stage in a rigorous judging process where throughout the year more than 2500 restaurants and caterers were judged by 584 anonymous judgesa. Through 22 regional and state awards events, restaurants & caterers were named the best in their category, and in their region and/or state, with the Restaurant or Caterer of the Year for 2008 being named on Monday night.
 
Quay Restaurant in Sydney were awarded Restaurant of the Year and the AJC Convention Centre at Randwick in NSW took out the Caterer of the Year.

People without valid working visas : new Penalties for employers

 

Do your employees have a valid visa to work in Australia?

 

You should check if a person has permission to work in Australia before you employ them. However, if you do not have immediate access to the Internet or a fax machine to check a visa holder’s work entitlements, you have 48 hours in which to initiate the checks.

 

From the 19th August 2007, it will be a criminal offence to knowingly or recklessly allow an illegal worker to work, or to refer an illegal worker for work.

Green Table Australia

The Green Table Australia scheme, created by R&CA, based on the Green Table program in Canada is intended to recognise restaurants and catering businesses that are doing what they can to reduce their CO2 emissions.

The program requires restaurants, cafes and caterers to commit to :-

• using natural gas or a minimum of 20% green electricity to power their stoves;
• send their organic waste to compost;
• recycle paper, plastic, glass, metal as much as possible;
• use energy-efficient equipment
